Indien de activiteiten van de ondernemer onder een relevant vergunningenstelsel vallen, worden de gegevens van de toezichthoudende autoriteit op verzoek aan de consument verstrekt.\r\n          <\/p>\r\n\r\n          <p>Indien De Ondernemer Een Gereglementeerd Beroep Uitoefent:<\/p>\r\n          <ol>\r\n            <li>the professional association or organisation with which they are affiliated;<\/li>\r\n            <li>de beroepstitel, en de plaats in de EU of de Europese Economische Ruimte waar deze is verleend;<\/li>\r\n            <li>\r\n              a reference to the professional rules applicable in the Netherlands and instructions on where and how\r\n              these\r\n              rules can be accessed.\r\n            <\/li>\r\n          <\/ol>\r\n        <\/article>\r\n\r\n        <article class=\"wtw-terms-article\" id=\"artikel-3\">\r\n          <h2><span>Artikel 3<\/span>Toepasselijkheid<\/h2>\r\n          <ol>\r\n            <li>\r\n              Deze Algemene Voorwaarden zijn van toepassing op elk aanbod van de ondernemer en op elke overeenkomst op afstand die tussen de ondernemer en de consument wordt gesloten.\r\n            <\/li>\r\n            <li>\r\n              Before the distance contract is concluded, the text of these terms and conditions will be made available\r\n              to\r\n              the consumer. If this is not reasonably possible, the entrepreneur will indicate \u2014 before the distance\r\n              contract is concluded \u2014 how the terms and conditions can be inspected at the entrepreneur\u2019s premises and\r\n              that\r\n              they will be sent free of charge to the consumer as soon as possible upon request.\r\n            <\/li>\r\n            <li>\r\n              If the distance contract is concluded electronically, the text of these terms and conditions may, by way\r\n              of\r\n              exception to the previous paragraph and before the distance contract is concluded, be made available to\r\n              the\r\n              consumer electronically in such a way that the consumer can easily store it on a durable medium. If this\r\n              is\r\n              not reasonably possible, it will be indicated where the terms and conditions can be consulted\r\n              electronically\r\n              and that they will be sent free of charge electronically or otherwise upon the consumer\u2019s request.\r\n            <\/li>\r\n            <li>\r\n              If specific product or service conditions also apply in addition to these terms and conditions, paragraphs\r\n              2\r\n              and 3 apply accordingly, and in the event of conflicting terms the consumer may always invoke the\r\n              provision\r\n              that is most favourable to them.\r\n            <\/li>\r\n          <\/ol>\r\n        <\/article>\r\n\r\n        <article class=\"wtw-terms-article\" id=\"artikel-4\">\r\n          <h2><span>Artikel 4<\/span>Het Aanbod<\/h2>\r\n          <ol>\r\n            <li>\r\n              If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated\r\n              in\r\n              the offer.\r\n            <\/li>\r\n            <li>\r\n              The offer contains a complete and accurate description of the products, digital content and\/or services\r\n              being\r\n              offered. The description is sufficiently detailed to enable the consumer to properly assess the offer. If\r\n              the\r\n              entrepreneur uses images, they are a truthful representation of the products, services and\/or digital\r\n              content\r\n              offered. Obvious mistakes or obvious errors in the offer are not binding on the entrepreneur.\r\n            <\/li>\r\n            <li>\r\n              Elk aanbod bevat zodanige informatie dat voor de consument duidelijk is welke rechten en verplichtingen aan de aanvaarding van het aanbod zijn verbonden.\r\n            <\/li>\r\n          <\/ol>\r\n        <\/article>\r\n\r\n        <article class=\"wtw-terms-article\" id=\"artikel-5\">\r\n          <h2><span>Artikel 5<\/span>De Overeenkomst<\/h2>\r\n          <ol>\r\n            <li>\r\n              Subject to the provisions of paragraph 4, the agreement is concluded at the moment the consumer accepts\r\n              the\r\n              offer and fulfils the conditions set out therein.\r\n            <\/li>\r\n            <li>\r\n              If the consumer has accepted the offer electronically, the entrepreneur will promptly confirm receipt of\r\n              the\r\n              acceptance electronically. As long as receipt of this acceptance has not been confirmed by the\r\n              entrepreneur,\r\n              the consumer may dissolve the agreement.\r\n            <\/li>\r\n            <li>\r\n              If the agreement is concluded electronically, the entrepreneur will take appropriate technical and\r\n              organisational measures to secure the electronic transfer of data and will ensure a safe web environment.\r\n              If\r\n              the consumer can pay electronically, the entrepreneur will observe appropriate security measures.\r\n            <\/li>\r\n            <li>\r\n              Within the legal framework, the entrepreneur may obtain information about whether the consumer can meet\r\n              their\r\n              payment obligations, as well as all facts and factors relevant to responsibly entering into the distance\r\n              contract. The\r\n              entrepreneur\r\n              may ask the consumer for the reason for withdrawal, but may not oblige the consumer to state their\r\n              reason(s).\r\n            <\/li>\r\n            <li>De In Lid 3 Bedoelde Herroepingstermijn Gaat In Op De Dag Na De Dag Waarop De Overeenkomst Is Gesloten.\r\n            <\/li>\r\n          <\/ol>\r\n\r\n          <p>\r\n            <strong>Extended withdrawal period for products, services and digital content not supplied on a tangible\r\n              medium\r\n              in the event of failure to inform about the right of withdrawal:<\/strong>\r\n          <\/p>\r\n          <ol start=\"5\">\r\n            <li>\r\n              Indien De Ondernemer De Consument Niet Heeft Voorzien Van De Wettelijk Vereiste Informatie Over Het Herroepingsrecht Of Het Modelformulier Voor Herroeping, Verloopt De Herroepingstermijn Twaalf Maanden Na Het Einde Van De Oorspronkelijke Herroepingstermijn Die Overeenkomstig De Voorgaande Leden Van Dit Artikel Is Vastgesteld.\r\n            <\/li>\r\n            <li>\r\n              Indien De Ondernemer De In Het Vorige Lid Bedoelde Informatie Binnen Twaalf Maanden Na De Startdatum Van De Oorspronkelijke Herroepingstermijn Aan De Consument Verstrekt, Verloopt De Herroepingstermijn 14 Dagen Na De Dag Waarop De Consument Die Informatie Heeft Ontvangen.\r\n            <\/li>\r\n          <\/ol>\r\n        <\/article>\r\n\r\n        <article class=\"wtw-terms-article\" id=\"artikel-7\">\r\n          <h2><span>Artikel 7<\/span>Verplichtingen Van De Consument Tijdens De Herroepingstermijn<\/h2>\r\n          <ol>\r\n            <li>\r\n              During the withdrawal period, the consumer will handle the product and its packaging with care. The\r\n              consumer\r\n              will only unpack or use the product to the extent necessary to establish the nature, characteristics and\r\n              functioning of the product. The guiding principle is that the consumer may only handle and inspect the\r\n              product\r\n              as they would be allowed to do in a shop.\r\n            <\/li>\r\n            <li>\r\n              The consumer is only liable for diminished value of the product resulting from handling of the product\r\n              that\r\n              goes beyond what is permitted in paragraph 1.\r\n            <\/li>\r\n            <li>\r\n              The consumer is not liable for diminished value of the product if the entrepreneur has not provided the\r\n              consumer with all legally required information about the right of withdrawal before or at the conclusion\r\n              of\r\n              the agreement.\r\n            <\/li>\r\n          <\/ol>\r\n        <\/article>\r\n\r\n        <article class=\"wtw-terms-article\" id=\"artikel-8\">\r\n          <h2><span>Article 8<\/span>Uitoefening van het herroepingsrecht van de consument en de kosten daarvan<\/h2>\r\n          <ol>\r\n            <li>\r\n              Als de consument gebruikmaakt van het herroepingsrecht, stelt hij de ondernemer binnen de herroepingstermijn daarvan op de hoogte door middel van het modelformulier voor herroeping of op een andere ondubbelzinnige wijze.\r\n            <\/li>\r\n            <li>\r\n              As soon as possible, but within 14 days from the day following the notification referred to in paragraph\r\n              1,\r\n              the consumer returns the product or hands it to (an authorised representative of) the entrepreneur. This\r\n              is\r\n              not required if the entrepreneur has offered to collect the product themselves. The consumer has observed\r\n              the\r\n              return period in any event if the product is returned before the withdrawal period has expired.\r\n            <\/li>\r\n            <li>\r\n              De consument retourneert het product met alle meegeleverde accessoires, indien redelijkerwijs mogelijk in de oorspronkelijke staat en verpakking, en overeenkomstig de redelijke en duidelijke instructies die door de ondernemer zijn verstrekt.\r\n            <\/li>\r\n            <li>\r\n              The risk and the burden of proof for the correct and timely exercise of the right of withdrawal lies with\r\n              the\r\n              consumer.\r\n            <\/li>\r\n            <li>\r\n              The consumer bears the direct costs of returning the product. If the entrepreneur has not stated that the\r\n              consumer must bear these costs, or if the entrepreneur indicates that they will bear the costs themselves,\r\n              the\r\n              consumer does not have to bear the costs of return.\r\n            <\/li>\r\n            <li>\r\n              If the consumer withdraws after first expressly requesting that the performance of the service or the\r\n              supply\r\n              of gas, water or electricity that is not prepared for sale in a limited volume or specific quantity begins\r\n              during the withdrawal period, the consumer owes the entrepreneur an amount proportional to that part of\r\n              the\r\n              obligation performed by the entrepreneur at the time of withdrawal, compared to full performance of the\r\n              obligation.\r\n            <\/li>\r\n            <li>\r\n              The consumer does not bear any costs for the performance of services or supply of water, gas or\r\n              electricity\r\n              that is not prepared for sale in a limited volume or quantity, or for the supply of district heating, if:\r\n              <ol type=\"a\">\r\n                <li>\r\n                  the entrepreneur has not provided the consumer with the legally required information about the right\r\n                  of\r\n                  withdrawal, the reimbursement of costs in the event of withdrawal, or the model withdrawal form; or\r\n                <\/li>\r\n                <li>\r\n                  the consumer has not expressly requested commencement of the performance of the service or supply of\r\n                  gas,\r\n                  water, electricity or district heating during the withdrawal period.\r\n                <\/li>\r\n              <\/ol>\r\n            <\/li>\r\n            <li>\r\n              De consument draagt geen kosten voor de volledige of gedeeltelijke levering van digitale inhoud die niet op een materi\u00eble drager is geleverd, indien:\r\n              <ol type=\"a\">\r\n                <li>\r\n                  prior to delivery, the consumer did not expressly agree to the commencement of performance of the\r\n                  agreement before the end of the withdrawal period;\r\n                <\/li>\r\n                <li>\r\n                  the consumer did not acknowledge losing the right of withdrawal by giving consent; or\r\n                <\/li>\r\n                <li>the entrepreneur failed to confirm the consumer\u2019s statement.<\/li>\r\n              <\/ol>\r\n            <\/li>\r\n            <li>\r\n              Als de consument gebruikmaakt van het herroepingsrecht, worden alle aanvullende overeenkomsten van rechtswege ontbonden.\r\n            <\/li>\r\n          <\/ol>\r\n        <\/article>\r\n\r\n        <article class=\"wtw-terms-article\" id=\"artikel-9\">\r\n          <h2><span>Article 9<\/span>Verplichtingen van de ondernemer bij herroeping<\/h2>\r\n          <ol>\r\n            <li>\r\n              If the entrepreneur allows the consumer to notify withdrawal electronically, they will send an\r\n              acknowledgement\r\n              of receipt promptly after receiving such notification.\r\n            <\/li>\r\n            <li>\r\n              The entrepreneur reimburses all payments made by the consumer, including any delivery costs charged by the\r\n              entrepreneur for the returned product, promptly and no later than 14 days after the day on which the\r\n              consumer\r\n              notifies the entrepreneur of the withdrawal. Unless the entrepreneur offers to collect the product\r\n              themselves,\r\n              the entrepreneur may withhold reimbursement until they have received the product or until the consumer\r\n              provides proof that the product has been returned, whichever is earlier.\r\n            <\/li>\r\n            <li>\r\n              The entrepreneur uses the same means of payment for reimbursement as the consumer used, unless the\r\n              consumer\r\n              agrees to another method. The reimbursement is free of charge for the consumer.\r\n            <\/li>\r\n            <li>\r\n              Als de consument heeft gekozen voor een duurdere leveringsmethode dan de goedkoopste standaardlevering, hoeft de ondernemer de bijkomende kosten voor die duurdere methode niet te vergoeden.\r\n            <\/li>\r\n          <\/ol>\r\n        <\/article>\r\n\r\n        <article class=\"wtw-terms-article\" id=\"artikel-10\">\r\n          <h2><span>Article 10<\/span>Uitsluiting Van Het Herroepingsrecht<\/h2>\r\n          <p>\r\n            The entrepreneur may exclude the following products and services from the right of withdrawal, but only if\r\n            the\r\n            entrepreneur clearly stated this in the offer, at least in good time before the conclusion of the agreement:\r\n          <\/p>\r\n          <ol>\r\n            <li>\r\n              Producten of diensten waarvan de prijs onderhevig is aan schommelingen op de financi\u00eble markt waarop de ondernemer geen invloed heeft en die zich binnen de herroepingstermijn kunnen voordoen;\r\n            <\/li>\r\n            <li>\r\n              Agreements concluded during a public auction. A public auction means a sales method whereby products,\r\n              digital\r\n              content and\/or services are offered by the entrepreneur to the consumer who is personally present or is\r\n              given\r\n              the opportunity to be personally present at the auction, under the direction of an auctioneer, and whereby\r\n              the\r\n              successful bidder is obliged to purchase the products, digital content and\/or services;\r\n            <\/li>\r\n            <li>\r\n              Dienstenovereenkomsten, na volledige uitvoering van de dienst, maar alleen als:\r\n              <ol type=\"a\">\r\n                <li>de uitvoering is begonnen met de voorafgaande uitdrukkelijke toestemming van de consument; en<\/li>\r\n                <li>the consumer has declared that they lose the right of withdrawal once the entrepreneur has fully\r\n                  performed the agreement;<\/li>\r\n              <\/ol>\r\n            <\/li>\r\n            <li>Package travel as referred to in Article 7:500 of the Dutch Civil Code and passenger transport\r\n              contracts;<\/li>\r\n            <li>\r\n              Service agreements for providing accommodation where the agreement provides for a specific date or period\r\n              of\r\n              performance and other than for residential purposes, goods transport, car rental services and catering;\r\n            <\/li>\r\n            <li>\r\n              Overeenkomsten met betrekking tot vrijetijdsactiviteiten waarbij de overeenkomst voorziet in een specifieke datum of periode van uitvoering;\r\n            <\/li>\r\n            <li>\r\n              Products manufactured according to the consumer\u2019s specifications, which are not prefabricated and which\r\n              are\r\n              produced on the basis of an individual choice or decision of the consumer, or which are clearly intended\r\n              for a\r\n              specific person;\r\n            <\/li>\r\n            <li>Producten die snel bederven of een beperkte houdbaarheid hebben;<\/li>\r\n            <li>\r\n              Sealed products which are not suitable for return for reasons of health protection or hygiene and whose\r\n              seal\r\n              has been broken after delivery;\r\n            <\/li>\r\n            <li>Producten die na levering door hun aard onlosmakelijk met andere producten zijn vermengd;<\/li>\r\n            <li>\r\n              Alcoholische dranken waarvan de prijs bij het sluiten van de overeenkomst is overeengekomen, maar waarvan de levering pas na 30 dagen kan plaatsvinden, en waarvan de werkelijke waarde afhankelijk is van schommelingen op de markt waarop de ondernemer geen invloed heeft;\r\n            <\/li>\r\n            <li>Verzegelde audio- en video-opnamen en computersoftware waarvan de verzegeling na levering is verbroken;<\/li>\r\n            <li>Kranten, tijdschriften of periodieken, met uitzondering van abonnementen hierop;<\/li>\r\n            <li>\r\n              De levering van digitale inhoud anders dan op een materi\u00eble drager, maar alleen indien:\r\n              <ol type=\"a\">\r\n                <li>de uitvoering is begonnen met de voorafgaande uitdrukkelijke toestemming van de consument; en<\/li>\r\n                <li>de consument heeft verklaard dat hij daardoor zijn herroepingsrecht verliest.<\/li>\r\n              <\/ol>\r\n            <\/li>\r\n          <\/ol>\r\n        <\/article>\r\n\r\n        <article class=\"wtw-terms-article\" id=\"artikel-11\">\r\n          <h2><span>Article 11<\/span>De Prijs<\/h2>\r\n          <ol>\r\n            <li>\r\n              During the period of validity stated in the offer, the prices of the products and\/or services offered will\r\n              not\r\n              be increased, except for price changes due to changes in VAT rates.\r\n            <\/li>\r\n            <li>\r\n              By way of exception to the previous paragraph, the entrepreneur may offer products or services whose\r\n              prices\r\n              are subject to fluctuations in the financial market over which the entrepreneur has no influence, at\r\n              variable\r\n              prices. This dependency on fluctuations and the fact that any prices stated are indicative will be stated\r\n              in\r\n              the offer.\r\n            <\/li>\r\n            <li>\r\n              Prijsverhogingen binnen 3 maanden na het sluiten van de overeenkomst zijn alleen toegestaan indien zij het gevolg zijn van wettelijke regelingen of bepalingen.\r\n            <\/li>\r\n            <li>\r\n              Price increases from 3 months after the conclusion of the agreement are only permitted if the entrepreneur\r\n              has\r\n              stipulated this and:\r\n              <ol type=\"a\">\r\n                <li>zij het gevolg zijn van wettelijke regelingen of bepalingen; of<\/li>\r\n                <li>\r\n                  de consument bevoegd is de overeenkomst op te zeggen met ingang van de dag waarop de prijsverhoging ingaat.\r\n                <\/li>\r\n              <\/ol>\r\n            <\/li>\r\n            <li>De in het aanbod van producten of diensten vermelde prijzen zijn inclusief btw.<\/li>\r\n          <\/ol>\r\n        <\/article>\r\n\r\n        <article class=\"wtw-terms-article\" id=\"artikel-12\">\r\n          <h2><span>Article 12<\/span>Uitvoering Van De Overeenkomst En Aanvullende Garantie<\/h2>\r\n          <ol>\r\n            <li>\r\n              The entrepreneur guarantees that the products and\/or services comply with the agreement, the\r\n              specifications\r\n              stated in the offer, the reasonable requirements of soundness and\/or usability, and the statutory\r\n              provisions\r\n              and\/or government regulations in force on the date the agreement was concluded. If agreed, the\r\n              entrepreneur\r\n              also guarantees that the product is suitable for use other than normal use.\r\n            <\/li>\r\n            <li>\r\n              Any additional warranty provided by the entrepreneur, their supplier, manufacturer or importer never\r\n              limits\r\n              the statutory rights and claims the consumer can assert against the entrepreneur under the agreement if\r\n              the\r\n              entrepreneur has failed to perform their part of the agreement.\r\n            <\/li>\r\n            <li>\r\n              An additional warranty means any undertaking by the entrepreneur, their supplier, importer or producer\r\n              whereby\r\n              they grant the consumer certain rights or claims that go beyond what they are legally obliged to do if\r\n              they\r\n              have failed to perform their part of the agreement.\r\n            <\/li>\r\n          <\/ol>\r\n        <\/article>\r\n\r\n        <article class=\"wtw-terms-article\" id=\"artikel-13\">\r\n          <h2><span>Article 13<\/span>Levering En Nakoming<\/h2>\r\n          <ol>\r\n            <li>\r\n              The entrepreneur will exercise the greatest possible care when receiving and executing orders for products\r\n              and\r\n              when assessing requests for the provision of services.\r\n            <\/li>\r\n            <li>De plaats van levering is het adres dat de consument aan de ondernemer kenbaar heeft gemaakt.<\/li>\r\n            <li>\r\n              With due observance of what is stated in Article 4 of these terms and conditions, the entrepreneur will\r\n              execute\r\n              accepted orders with due speed, but at the latest within 30 days, unless a different delivery period has\r\n              been\r\n              agreed. If delivery is delayed, or if an order cannot or can only partially be executed, the consumer will\r\n              be\r\n              informed of this at the latest 30 days after placing the order. These collection costs amount to a maximum of: 15% on outstanding amounts up to \u20ac2,500; 10% on\r\n              the\r\n              next \u20ac2,500; and 5% on the next \u20ac5,000, with a minimum of \u20ac40. If a\r\n              complaint requires a foreseeably longer processing time, the entrepreneur will respond within the 14-day\r\n              period with an acknowledgement of receipt and an indication of when the consumer can expect a more\r\n              detailed\r\n              answer.\r\n            <\/li>\r\n            <li>\r\n              A complaint about a product, service or the entrepreneur\u2019s service can also be submitted via a complaint\r\n              form\r\n              on the consumer page of the Thuiswinkel.org website.
